General Terms and Conditions of Sale

These General Terms and Conditions of Sale govern the contractual relationship between the Customer (hereinafter referred to as the “Customer”) and Laurent Marien SRL, a private limited liability company operating under the trade name Bloom Brussels (hereinafter the “Company”). Bloom Brussels is the brand operated by Laurent Marien SRL for the online sale of eyewear and accessories through the website www.bloom-brussels.be.

Article 2 : Definitions 

In these General Terms and Conditions: 

Company: Laurent Marien SRL, operating the online sales website Bloom Brussels
Customer: any natural or legal person placing an order through the website. 
Products: eyewear, accessories, and any other items offered for sale. 

Article 3 : Scope of Application

3.1 These General Terms and Conditions apply to all offers, sales, and deliveries made through the Company’s website under the trade name Bloom Brussels. 

3.2 By confirming an order, the Customer unconditionally accepts these General Terms and Conditions of Sale. 

3.3 The specific provisions relating to the right of withdrawal apply only to consumer Customers. Professional Customers do not benefit from this right. 

3.4 Any deviation from, or special condition to, these Terms shall be valid only if expressly accepted in writing by the Company. 

3.5 The contract may be concluded in French, Dutch, or English. 

Article 4 : Modification of the General Terms and Conditions 

The Company reserves the right to modify these General Terms and Conditions of Sale at any time.Any modifications will be published on the website and shall take effect immediately upon posting online. The Terms and Conditions applicable are those in force on the date the Customer places the order. 

Article 5 : Applicable Law and Jurisdiction

5.1 These General Terms and Conditions are governed exclusively by Belgian law. 

5.2 In the event of a dispute, the courts of the judicial district of Brussels shall have exclusive jurisdiction. 

Orders and Transactions

Article 6 : Formation of the Contract

6.1 The Products are presented as accurately as possible. Slight variations (particularly in color) may occur depending on the display or screen settings. 

6.2 Before confirming the order, the Customer has the opportunity to review its details and correct any possible errors. 

6.3 The contract is deemed concluded upon the sending of the order confirmation email by the Company. 

6.4 The Company reserves the right to refuse or cancel any order in the event of a prior dispute, suspected fraud, or an obvious error in the price or availability of the Products. 

Article 7 : Prices

7.1 Prices are indicated in euros (EUR), including VAT but excluding delivery costs. 

7.2 Delivery costs are specified separately at the time of the order. 

7.3 In the event of an obvious pricing error, the Company reserves the right to cancel the order. 

Article 8 : Payment 

8.1 Payment is made online using the secure payment methods offered on the website. 

8.2 Orders are processed only after full payment has been received. 

8.3 The Company declines all responsibility in the event of a malfunction attributable to the payment service providers. 

Article 9 : Delivery

9.1 Deliveries are made within Belgium and the European Union. 

9.2 Delivery times are indicative only. A slight delay shall not give rise to any compensation. Unless otherwise agreed, delivery shall take place within a maximum of 30 days from the order confirmation. 

9.3 The transfer of risk occurs upon delivery to the Customer. 

9.4 In the event of an incorrect address or absence at the time of delivery, the cost of reshipment shall be borne by the Customer. 

After-Sales Service and Warranties

Article 10 : Legal Warranty 

10.1 All Products are covered by the 2-year legal warranty of conformity (Articles 1649bis to 1649octies of the Belgian Civil Code). 

10.2 This warranty covers defects that existed at the time of delivery. 

10.3 For any warranty claim, the Customer must contact the Company within a reasonable period from the discovery of the defect, providing proof of purchase and a clear description of the defect. 

10.4 The warranty does not cover: 

• normal wear and tear, 
• damage resulting from improper or negligent use, 
• unauthorized modifications or repairs, 
• failure to follow care instructions. 

10.5 In the event that a defect is acknowledged, the Customer may obtain repair, replacement, a price reduction, or a refund, at no cost. 

10.6 The legal warranty is independent of any commercial or manufacturer’s warranty that may apply. 

Article 11 : Right of Withdrawal (B2C Only)

11.1 The consumer Customer has 14 calendar days from the date of receipt to exercise their right of withdrawal. 

11.2 The Customer must notify the Company clearly of their decision (by email or via the online form). 

11.3 Products must be returned in their original condition, at the Customer’s expense, within 14 days following this notification. The Customer bears the transport risk until the Products are received by the Company. 

11.4 Refunds will be made within 30 days of receipt of the returned Products, using the same payment method as the original transaction. 

11.5 The right of withdrawal does not apply to customized Products (e.g. prescription lenses made to the Customer’s specifications). 

Article 12 : Liability  

12.1 The Company shall only be liable for direct damages resulting from a proven fault. 

12.2  Under no circumstances shall the Company be held liable for indirect losses, such as loss of income, data, customers, or damage to reputation. 

12.3 In any event, the Company’s liability shall be limited to the total amount of the order.
